Terms and conditions of provision of Activ services
- In accordance with legislation of the Republic of Kazakhstan all Subscribers of cellular communication should be duly registered. In this respect it is necessary to fill in and sign a registration form in the Kazakh or Russian languages (at your discretion), provided in the point-of-sale of Activ cards where you have purchased the start package, and to return the above filled in form to the point-of-sale.
- When Subscriber’s account balance equals to 0 (zero), the service will stop immediately: current call will be discontinued, all outgoing communication will be blocked. Subscriber will be able to receive calls until the validity of the last voucher expires. Validity of call units/tenge is shown on the back of each voucher.
- You can top-up your account with no more than 64 500 call units, thereat their period of validity will correspond to the term specified on the back of the Activ voucher.
- Bill itemization is provided only to the phone number owner and covers a particular accounting period. Itemization of calls for a particular accounting period is provided on a free-of-charge basis. Period itemized – the current month, or previous month up to the 15th of the current month.
- ActiV Subscriber can receive information about his/her account balance by calling 7171, or by sending a free USSD request to *111#.
- The Company does not bear any property, financial or other responsibility for:
- the quality and volume of received and transmitted by Subscriber information;
- information compliance with expectations of the Subscriber;
- the suitability of information for any purposes as well as for its other peculiarities;
- the short-received profit, losses, lost opportunities, etc. They may be claimed by the Subscriber in the event of impossibility in getting services.
- The Company does not bear any responsibility in the event of impossibility in getting services by the Subscriber if it resulted from the reasons not directly dependent on the Company or its operations. Any claim of the Subscriber, who has not filled in a Registration Form in due time, will be disregarded.
- The Company may suspend or terminate the provision of the Activ communication services without any prior notice to the Subscriber in case:
- Of receipt of Subscriber’s notice of lost/stolen mobile phone (provided that Subscriber has filled in the Registration Form); Subscriber pays for the services provided prior to receipt of the notice of lost/stolen mobile phone.
- it came to knowledge that the Subscriber’s telephone or provided to Subscriber services are used by an authorized person, improperly or illegally or for the criminal purposes;
- the Subscriber infringes any of the procedures related to provision of Activ services and/or the Subscriber maliciously calls up emergency services or maliciously dials other telephone numbers aiming to wrongful acts conduct;
- it came to knowledge that the services of the AtiV-card have been received roguishly (as a result of theft of the Activ-card, breakage of code or code protection layer or other wrongful acts), it came to knowledge or there are bases to assume that the Subscriber has tried or is trying to renew servicing through credit, intending to pay for the above services throught the stolen Activ-card or otherwise, using to that effect the prohibited for servicing Activ-card;
- the telephone of Subscriber, who filled in a registration form, has been lost or stolen at the time of receipt of notification;
- the Subscriber conducts acts, which to the Company’s opinion may be harmful to Company’s mobile network functioning;
- there are observed other reasons, being beyond the Company’s competence, though the influence of which are determined by provisions of the Laws of the Republic of Kazakhstan.
- In all cases, listed in item 8 herein, the Subscriber shall be liable to all required payments. The Subscriber shall also be completely liable to all his acts or the acts of third persons performed with the use of the Subscriber’s network details resulting in financial, material or other losses of the Company. If the Company has exercised its right of suspension or termination of services provision to such Subscriber, it may refuse to continue to support such Subscriber.
- The Company may alter the terms and conditions of provision of Activ services without prior notice to the Subscriber.
- The cost of provision of Activ services is listed in the Company’s Tariffs. The Company may alter applicable tariffs, notifying its Subscribers on such alterations through mass media.
- The Subscriber may have the right to use a mobile telephone, servicing of which is authorized in the territory of the Republic of Kazakhstan. The Subscriber should strictly observe the instructions, prescribed to him by the Company and being subject to indispensable condition of provision of Activ services. The Subscriber should not perform calls covered by other receiving Subscriber. The Subscriber should not receive calls with reverse charging. These conditions would remain in force if the Subscriber allows another person to use his phone.
- The Company is entitled to check the identity of the Subscriber’s number through the network aiming to identify this number with the number on the connected mobile terminal. This check may be used to get off the malicious phone calls addressed to the Company as well as to get off the cases of fraud.
- It’s hardly probable but possible that the Company will have to occasionally change the ID number of the voice mail, the telephone number or any other number committed to the Subscriber. In this case the Company notifies the Subscriber on happened changes.
- The Company in this Manual is meant as “GSM Kazakhstan OJSC Kazakhtelecom” LLP; the Subscriber as the Subscriber of Activ services of GSM network of Kazakhstan; the Activ support as the all services the Subscriber is entitled to thereof. All other references written with the capital letters should have the meaning assigned to them hereunder.
- Activ package or Activ-card purchase by the Subscriber shall be deemed as assumption of terms and conditions of “GSM Kazakhstan OJSC Kazakhtelecom” LLP on provision of Activ services.
- Disputes between the parties shall be settled by way of negotiations if possible. If such disputes cannot be resolved by way of negotiations, they may be submitted at parties’ option to the law courts of the Republic of Kazakhstan at the place of location of the Company or other court in accordance with legislation of the Republic of Kazakhstan in case of written consent of the Company.
Subscriber may:
- Receive services provided only his/her account balance is positive. If, despite the fact that Subscriber has got no money in his/her account, Subscriber continues using the services, he/she bears full responsibility for their payment.
- Provide Operator with true and accurate personal data (full name, ID card details, TRN), bank details of a legal entity, registered address at the place of residence as well as other information as may be required for contract purposes. In the event of change in the above data, provides Operator with new data in writing within 5 days after such changes become effective.
- Not use his/her phone number for lotteries, voting, quiz, advertising and other events which may lead to a breach of third party rights, or cause a failure of the communication equipment or devices.
- In case if Subscriber intends to sell/transfer his/her mobile number, he/she carries out a mandatory re-registration of this Agreement to a new Subscriber. Failing which, Subscriber’s mobile number may be blocked.
Operator shall:
- Not be liable for the Subscriber’s expenses resulting from a failure to properly dial mobile phone numbers provided they has been registered by the Operator’s technical services.
